These Terms and Conditions govern your use of the website at concretesierravista.com (the "Site") and your engagement with Advanced Sierra Vista Concrete (the "Company") for concrete contracting services. By using the Site or requesting services from the Company, you agree to be bound by these Terms. If you do not agree, please do not use the Site or engage our services.
By accessing the Site, submitting an inquiry, or entering into a service agreement with the Company, you confirm that you have read, understood, and agreed to these Terms. These Terms apply to all visitors, customers, and others who access or use the Site or our services. We reserve the right to update these Terms at any time, and continued use of the Site or our services after such changes constitutes acceptance of the revised Terms.
Advanced Sierra Vista Concrete provides concrete contracting services to residential and commercial customers in Sierra Vista, AZ and surrounding areas, including but not limited to:
The Company reserves the right to decline any project at its discretion. A service agreement is not formed until both parties have signed a written contract or the Company has confirmed the scope and price in writing and received any required deposit.
All estimates provided by the Company are based on information available at the time of assessment and are valid for 30 days from the date of issue unless otherwise stated in writing. Estimates are not binding contracts.
Final pricing may be adjusted if site conditions discovered during work differ materially from what was visible during the initial estimate. If a change in scope or cost is required, the Company will notify you before proceeding with the additional work, and you must provide written or verbal approval before work continues.
Any verbal estimates or ballpark figures provided over the phone or during an initial conversation are informational only and do not constitute a binding quote.
Project start dates are scheduled based on crew availability, permit timelines, and weather conditions. The Company will make reasonable efforts to adhere to the agreed schedule but is not liable for delays caused by weather, material shortages, permit processing delays, or other conditions outside our control.
If you need to cancel or reschedule, please notify us as soon as possible. Deposits paid to secure a project date may be non-refundable if cancellation occurs less than 5 business days before the scheduled start date, unless otherwise agreed in writing.
The Company reserves the right to reschedule work due to unsafe weather conditions, including but not limited to rain, extreme heat, or freezing temperatures that would compromise the quality of the concrete work.
Payment terms will be specified in your written contract or estimate. In general, a deposit is required to secure your project on the schedule, with the remaining balance due upon project completion unless otherwise agreed in writing.
Accepted payment methods will be confirmed at the time of agreement. Invoices not paid within the agreed timeframe may be subject to a late payment fee as specified in your contract.
If payment is not received after reasonable notice, the Company reserves the right to pursue collection through available legal means, including filing a mechanic's lien on the property where work was performed, as permitted under Arizona law.
You agree to:
The Company is not responsible for damage caused by conditions you failed to disclose or for delays caused by your failure to prepare the site as requested.
Any warranty on workmanship will be specified in your written contract. Where no written warranty is provided, the Company represents that work will be completed in a workmanlike manner consistent with industry standards.
Concrete is a natural material subject to cracking, color variation, and surface changes over time, particularly in climates with temperature extremes, moisture cycles, and expansive soils - all conditions present in southeastern Arizona. Minor hairline cracking and surface variations are inherent characteristics of concrete and are not covered by workmanship warranties.
The Site and its content are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, the Company is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from services provided under a service agreement.
In no event will the Company's total liability to you exceed the amount paid by you to the Company for the specific project giving rise to the claim.
If a dispute arises out of or relating to these Terms or any service agreement, both parties agree to first attempt to resolve it through direct, good-faith communication. Either party may contact the other in writing to initiate a resolution conversation.
If a dispute cannot be resolved informally, both parties agree to submit to binding arbitration in Cochise County, Arizona, under the rules of the American Arbitration Association, before pursuing litigation. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 9 will be brought in the state or federal courts located in Cochise County, Arizona, and you consent to personal jurisdiction in those courts.
